Lyons facing murder charge in son's death

WASHINGTON — Corey Lyons is facing a murder charge in the death of his four-month-old son, Levi J. Lyons.

Lyons, 21, Washington, is accused of a Class A felony charge of murder and a Class A felony charge of neglect of a dependent resulting in death. Lyons could be given the death penalty if convicted of the murder charge.

Daviess County Prosecutor Dan Murrie said Tuesday that he has not ruled out seeking the death penalty against Lyons.

“I’m considering all options right now,” Murrie said.

The probable cause affidavit, sealed before formal charges were filed, said Lyons told police detectives several versions on how Levi obtained the injuries that would eventually kill him.

According to the affidavit, police arrived at 1000 W. Main St., at 9:16 p.m. after a 911 call from Corey saying the baby fell.

When detectives arrived at the house at 9:22 p.m., Corey told them Levi fell out of a bouncy chair and hit his head on the bed.

Corey was taken to the police station for questioning, according to the affidavit. He told detectives after further questioning that the baby fell out of his arms.

Corey then told investigators a little later that he did drop the baby on purpose but surmised he could catch Levi and the baby would fall on his rear.

“(The detective) asked him why he did it and (Corey) stated that he thought it would scare (Levi) enough that he would stop crying,” the affidavit said.

Levi was pronounced dead at Daviess Community Hospital and an autopsy on the baby was performed on June 28 in Terre Haute. Preliminary findings indicate the baby died of blunt force trauma to the head.

Corey was interviewed on June 29 at the Daviess County Security Center and was confronted on his truthfulness. After changing a diaper, he said Levi would not stopped crying and said “(I) could not take it anymore.”

The affidavit said Corey knelt down, picked the baby up by the shoulders and threw the baby’s head into the floor multiple times. He then called 911.

Levi Lyons was buried Friday in Fairview Cemetery. Corey Lyons was allowed by Superior Court Judge Dean Sobecki to attend the funeral with a Sheriff’s Department escort but the escort was not needed as he did not attend.

The family, including the baby’s mother Savanna J. Johnson, called city police and complained drivers were passing by the house and harassing them. They have since moved, according to police reports.

Lyons is being held in the Daviess County Security Center on $1,000,000 bond.
