Parkview requests bonds from DCEDC

NOTICE OF PUBLIC HEARING

Notice is hereby given that the Daviess County Economic Development Commission (the “Commission”) will hold a public hearing on July 8, 2009 at 8:30 a.m., in the Commissioners’ Room, Courthouse, 200 E. Walnut Street, Washington, Indiana 47501, regarding a request from Parkview Village Christian Care, Inc., an Indiana nonprofit public benefit corporation and an organization described in Section 501(c)(3) of the Internal Revenue Code of 1986, as amended (the “Borrower”) to Daviess County, Indiana (the “Issuer”) to issue its Economic Development Revenue Bonds, Series 2009 (Parkview Village Christian Care, Inc. Project) (the “Bonds”) in an aggregate principal amount not to exceed $4,500,000. The proceeds of the Bonds will be loaned to the Borrower for the purpose of financing and refinancing certain economic development facilities to be owned and operated by the Borrower consisting of the acquisition, construction, installation and equipping of an approximately 38,000 square foot assisted living facility located at 800 S. West Street, Odon, Indiana 47562 (the “Project”). The Project will be owned and operated by the Borrower as an assisted living facility.

The Bonds will be issued by the Issuer pursuant to Indiana Code Section 36-7-11.9 and 12, as supplemented and amended, and an ordinance proposed for the adoption by the County Council of the Issuer. The Bonds will not be in any respect general obligations of the Issuer, the State of Indiana, or any political subdivision thereof, but will be special, limited obligations of the Issuer as the principal of, premium, if any, and interest on the Bonds will be payable solely from the revenues and receipts derived from the repayment of the loan by the Borrower. The Bonds will not be payable in any manner from revenues raised by taxation. The bonds shall not constitute a debt, liability or obligation of the Issuer, the State of Indiana or any political subdivision thereof, or a pledge of the faith and credit or taxing power of any of them, and shall be payable only as aforesaid.

The public hearing is being held pursuant to Section 147(f) of the Internal Revenue Code of 1986, as amended, and Indiana Code 36-7-12-24(a). The public is invited to comment on any of the matters herein noted, and all taxpayers, residents or interested persons who appear will be given a reasonable opportunity to express their views, both orally and in writing, on the proposed plan of financing for the Project and other matters relating to the Bonds. Written comments may also be submitted to the Commission through its Counsel, Jeffrey E. Hayes, Esq., P.O. Box 650, Washington, Indiana 47501, until 5:00 p.m. July 7, 2009.
