By virtue of an Order of Sale, directed to me from the Clerk of the Daviess Circuit Court and pursuant to a Judgment of Foreclosure entered on July 6, 2009, I will expose to public sale to the highest bidder for cash in hand, at the office of the Sheriff of Daviess County, in Daviess County, Indiana, located at 101 N.E. 4th Street, Washing-ton, IN 47501 on October 14, 2009 at 10:00 a.m. Local Time, the fee simple title together with the rents, profits, issues and income or so much thereof as may be sufficient to satisfy said judgment, interest, costs and accruing costs of the following described real estate located in Daviess County, Indiana, to-wit:
A part of the Southeast Quarter of the Southeast Quarter of Section 9, Township 2 North, Range 7 West, Daviess County, Indiana. Beginning at a nail marking the southwest corner of said quarter-quarter section and running along the quarter-quarter section line, north [the west line of the Southeast Quarter of the Southeast Quarter of said Section 9 is the assumed bearing reference for all course calls in this description] [through a 5/8 inch steel rod with cap (MRF-11238) set flush at 25.00 feet] for a distance of 311.73 feet to a 5/8 inch steel rod with cap (MRF-11238) set flush; thence running South 64 degrees 27 minutes 10 seconds East for 396.82 feet to a 5/8 inch steel rod with cap (MRF-11238) set flush on the west right-of-way line of Indiana State Highway 57 {at thirty (30) feet from the center of roadway] being on a non-tangent 00 degrees 29 minutes 55 seconds horizontal curve; thence along said 00 degrees 29 minutes 55 seconds horizontal curve to the left, whose chord bears South 31 degrees 48 minutes 50 seconds West for 114.44 feet to a 5/8 inch steel rod with cap (MRF-11238) set flush; thence on a battered right-of-way line, South 70 degrees 28 minutes 06 seconds West [South 70 degrees 16 minutes 06 seconds West for 79.23 feet recorded] for 78.82 feet to a 5/8 inch steel rod with cap (MRF-11238) set flush; thence South for 18.07 feet [South 16.91 feet recorded] to the south line of said section; thence along said south line North 89 degrees 43 minutes 32 seconds West for 223.41 feet [North 89 degrees 47 minutes 52 seconds West for 223.87 feet recorded] to the point of beginning, containing 1.682 acres, more or less.

This sale is to be made in all respects pursuant to an act of the General Assembly of the State of Indiana, approved March 7, 1931, and entitled An act concerning proceedings in actions to foreclose real estate mortgages, providing for the sale and custody of the mortgaged premises and repealing all laws conflicting therewith (see Indiana Code).
It is further provided by law that there shall be no redemption from such sale, and the purchaser at such sale, upon complying with the terms of his purchase, shall be entitled to immediately receive from the undersigned, Sheriff of Daviess County, a deed conveying to him, the purchaser, the fee simple title in and to said real estate.
