ORDINANCE NO. 34
BE IT ORDAINED BY THE TOWN COUNCIL, OF THE TOWN OF CANNELBURG, DAVIESS COUNTY, INDIANA THAT BILL NO. HB 1177, use of Golf Carts, is hereby added to prved as follows:
GOLF CARTS
DEFINITIONS:
For the purpose of ordinance the following definitions shall apply unless the context clearly indicates or requires a different meaning:
(a) “Golf Cart” - A vehicle with four wheels originally designed for operation on a golf course and powered by a battery or internal combustion motor.
(b) “Driver’s License” - A valid license to operate a motor vehicle issued by Indiana or any other state.
(c) “Financial Responsi-bility” - Liability insurance coverage on a golf cart in an amount not less than required by Indiana law for motor vehicles operated on public highways in the State of Indiana.
OPERATION OF GOLF CART
The operation of a golf cart within the Town of Cannelburg is strictly prohibited unless the golf cart is operated and equipped in full compliance with this Ordinance. Golf cart also has to comply with state of Indiana safety requirements with plates and licensed driver.
OPERATOR
Only persons over six-teen (16) years of age and holding a driver’s license may operate a golf cart.
FINANCIAL RESPON-SIBILITY
The financial ability of the operator or owner notwithstanding, the operator of a golf cart must show financial responsibility when operating a golf cart. Written proof of financial responsibility must be available either on the golf cart or carried by the operator at all times.
TIME OF OPERATION
Golf carts shall not be operated on town streets between the time of 10 p.m. - 5 a.m. Golf carts are to be equipped with head, tail, brake lights, with safety equipment installed, and turning signals at all times.
PLACE OF OPERA-TION
Golf carts may be operated on town streets which have a posted speed limit of thirty (30) miles per hour or less. Golf carts may not be operated on the following national or state highways except to cross said highways at intersections to said highway: US 50 to 900E.
OCCUPANTS
The number of occupants in a golf cart shall be limited to the number of persons for whom the factory seating is installed and provided on the golf cart. Occupants must be at least three (3) years of age. The operator and all occupants shall be seated in the golf cart and no part of the body of the operator or occupant shall extend outside the perimeter of the golf cart while the golf cart is being operated.
TRAFFIC RULES
The operator of the golf cart shall comply with all traffic rules and regulations adopted by the State of Indiana and the Town of Cannelburg which govern the operation of motor vehicles. Golf carts must have rear view mirrors.
SLOW MOVING VEHICLE SIGN
All golf carts must display on the back of the golf cart a “slow moving vehicle” sign of the same type required under Indiana Law.
PENALTY
A violation of any provision of the Ordinance shall constitute a violation of the Town of Cannelburg Town Ordinance. An owner, leasee or operator may be cited to appear in a court of competent jurisdiction by issuance of an Indiana Uniform Traffic Ticket. Upon a finding by such court that an owner, leasee or operator of a golf cart has violated any provisions of the Ordinance, such person shall be subject to a fine not to exceed $100.00 for each offense along with Court costs in the amount same now exists or may be hereafter be determined by ordinance or statute.
EFFECTIVE
This Ordinance shall be in full force and effect from and after its passage and publication as required by law.
