WASHINGTON — SUMMONS BY PUBLICATION STATE OF INDIANA COUNTY OF DAVIESS SS: IN THE DAVIESS CIRCUIT COURT CAUSE NO. 14D01-1008-CC-128 RLW ACCOUNTS, LLC Plaintiff vs BENITA MAGAN, Defendant SUMMONS BY PUBLICATION COMES NOW the Plaintiff, RLW Accounts, LLC("RLW"), by counsel, having filed its Complaint and Affidavit in the above-entitled cause, hereby requests that the Clerk of Daviess Superior Court, issue the Summons by publication as follows: 1. This Summons by publication is specifically directed to Defendant, Benita Magan, whose last known address was and is: 412 E. South St., Washington, Indiana 47501, her present address is unknown. 2. The nature of the above-captioned cause is that on December 2, 2002, Defendant, Benita Magan executed and entered into a First USA Bank, N.A. Cardholder Agreement (the "Agreement"). As of August 5, 2010, the principal balance owing is $9,049.51, plus accrued interest in the amount of $4,765.25, for a total amount owing of $13,814.76, plus accruing interest and costs. 3. RLW has accelerated the entire balance due and owing on the Agreement, due to Defendant's failure to make the required payments and is also responsible for prejudgement interest as set forth in the Agreement. 4. The Defendant, Benita Magan, named herein must answer this Summons in writing, personally or by counsel, on or before thirty (30) days from the date of the third publication hereof.
